All persons are required to fill out a Waiver and Release of Liability before being provided transportation by The Whole Person

Anyone who does not completed this waiver and release will not be provided transportation.

Please read carefully! Upon submission, this is a legal acknowledgement of the following:

This Release and Waiver of Liability (the “Release”) is executed on DATE and TIME listed below, by NAME listed below (the “Participant”) in favor of The Whole Person, Inc., a Missouri nonprofit corporation, and its directors, officers, employees, volunteers and agents (collectively, the “Released Parties”).

The Participant desires to transportation to and from The Whole Person, 3710 Main St., Kansas City, Missouri for the purpose of voting.

The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:

RELEASE AND WAIVER. In consideration of The Whole Person, Inc.’s agreement to provide Participant transportation Participant does hereby release and forever discharge and hold harmless the Released Parties and their successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise against The Whole Person, Inc. Participant understands that this Release discharges the Released Parties from any liability or claim that the Participant may have against the Released Parties with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Participant’s Activities with The Whole Person, Inc., including, but not limited to, any liability or claim arising from or relating to the negligence of the Released Parties. Participant also understands that the Released Parties do not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.
ASSUMPTION OF RISK – COVID-19. I understand that while The Whole Person has taken reasonable steps to lessen the risk of transmission of COVID-19, The Whole Person is not responsible in any manner for any risks related to COVID-19. I understand that the World Health Organization has classified the COVID-19 outbreak as a pandemic. I further understand that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes Covid-19 may result in significant personal injury or death. I understand that there are inherent risks of COVID-19 transmission that cannot be eliminated regardless of the care taken to avoid such risks. I hereby voluntarily accept and assume all risk of loss, personal injury, sickness, death, damages and expense arising from such inherent risks. Furthermore, I represent and warrant that I am not infected with COVID-19 and am not experiencing any symptoms of COVID-19 including but not limited to, shortness of breath, cough, fever, fatigue, loss of taste or smell, headache or sore throat.
PHOTOGRAPHIC RELEASE. Participant does hereby grant and convey unto The Whole Person, Inc. all right, title, and interest in any and all photographic images and video or audio recordings made by The Whole Person, Inc. during the Participant’s Activities with The Whole Person, Inc., including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
OTHER. Participant expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Missouri, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Missouri. Participant agrees that in the event that any clause or provision, or portion of any clause or provision, of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable. This release shall remain valid and effective for all Activities engaged in by Participant unless Participant revokes the release by providing written notice to The Whole Person, Inc. Participant agrees to be fully bound by this electronic release upon submission to The Whole Person, Inc.
