Big Dill Classic Waiver (for players)

Please read carefully!  Upon submission, this is a legal acknowledgement of the following:

This Release and Waiver of Liability (the “Release”) is executed on DATE and TIME listed below, by NAME listed below (the “Participant”) in favor of The Whole Person, Inc., a Missouri nonprofit corporation, and its directors, officers, employees, volunteers and agents (collectively, the “Released Parties”). 

The Participant desires to play in The Big Dill Classic Pickleball and Cornhole Tournament on Sunday, August 18th, 2023 at Chicken N Pickle, 5901 W. 135th Street, Overland Park, KS 66223.

The Participant hereby freely, voluntarily, and without duress executes this Release under the following terms:

1. RELEASE AND WAIVER. In consideration of Participant’s willingness to play in The Big Dill Classic Pickleball and Cornhole Tournament, and The Whole Person, Inc.’s agreement to permit Participant to engage in activities with The Whole Person, Inc. and the individuals it services, Participant does hereby release and forever discharge and hold harmless the Released Parties and their successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Participant’s Activities with The Whole Person, Inc. Participant understands that this Release discharges the Released Parties from any liability or claim that the Participant may have against the Released Parties with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Participant’s Activities with The Whole Person, Inc., including, but not limited to, any liability or claim arising from or relating to the negligence of the Released Parties. Participant also understands that the Released Parties do not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.
2. MEDICAL TREATMENT. Participant does hereby release and forever discharge the Released Parties from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Participant’s Activities with The Whole Person, Inc.
3. ASSUMPTION OF THE RISK. The Participant understands the physical nature of the activity they are participating in. Participant hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases the Released Parties, from all liability for injury, illness, death, or property damage resulting from the Activities.
4. INSURANCE. The Participant understands that, except as otherwise agreed to by The Whole Person, Inc. in writing, The Whole Person, Inc. does not carry or maintain health, medical, or disability insurance coverage for any Participant. Each Participant is expected and encouraged to obtain his or her own medical or health insurance coverage.
5. PHOTOGRAPHIC RELEASE. Participant does hereby grant and convey unto The Whole Person, Inc. all right, title, and interest in any and all photographic images and video or audio recordings made by The Whole Person, Inc. during the Participant’s Activities with The Whole Person, Inc., including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
6. OTHER. Participant expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Missouri, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Missouri. Participant agrees that in the event that any clause or provision, or portion of any clause or provision, of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable. This release shall remain valid and effective for all Activities engaged in by Participant unless Participant revokes the release by providing written notice to The Whole Person, Inc.  Participant agrees to be fully bound by this electronic release upon submission to The Whole Person, Inc.
